Why dont Apple honour statutory rights?

We went to Apple Southland with an Iphone 4 that was a year out of contract but had started to develop numerous problems. The phone is in perfect cosmetic condition as it has been looked after. The manager Dani would not accept that the ACCC allows for replacements or repairs of items that are no longer performing as they should. She insisted two years was reasonable time: it is not for an item that is costly and well looked after. We had to pay $229 for a refurbished phone. The staff member then made me sign a document that was clearly printed for my husband to sign, again negating his legal rights. Anybody else had similar problems as I am launching a case with the ACCC as I believe Apple think they operate as their own entity without due respe

Are you saying the law establishes an infinite warranty in your country? If you win your case I wouldn't expect to find any manufacturers to continue selling items in your country.


My understanding in the UK is the manufacturer offers a 1 year warranty and the seller adds another one year for parts that it is agreed should not have failed in that two year period. Your complaint here makes it appear your iPhone was older than 2 years. Is this correct?

Things are a touch more complex in the UK because of the EU regulations which tend to conflict. A buyer here will usually get a twelve month additional guarantee to cover manufacturing defects 'present at the time of sale'. But the Sale of goods act can be extended to cover reasonable expectations up to six years. Then the EU insists on a virtually unconditional guarantee for two years.


In the end, it is all down to what the buyer knows about the regulations, and what trouble they are willing to go to to enforce them.

Its not the battery, its call dropping out, the home button works spasmodically, the volume turns itself up and down etc etc. I have two iphones and four ipads in my household and dont complain without reason. All of our other Apple products are great ( we keep having to buy ipads because of cracked screens-but that is the kids fault). I will see this through to the highest level because it is just not right in my eyes.

And so you should. What you are finding is the product not meeting reasonable expectations and for that you may need to start with the sale of goods act via the Citizens advice bureau.


But having composed your approach try sending a copy to the Store manager before you pursue it further, telling them what you propose to do. The store may suddenly feel they don't want the hassle because once enquiries start, the paper-work mounts rapidly.

While I don't agree with seventy one's analysis, and now understand whey electronics sold in the EU cost more, I would suggest that you narrow the focus you are going to appeal on to just the home button.


Any phone can drop calls from the first day it is activated to its last day of use. The problem is determining whether it is a problem with the phone or the carrier and to determine this you would have to capture information when the call fails.


The volume shifting has been seen on both phones and on iPods. Usually it is as a result of interference, i.e. cell phones can interfere with an iPod Shuffle and cause the volume to vacillate.


The home button would be your best choice to base your argument on as you can easily do research and find others with failing buttons. Widen your search to the iPhone 5 and 6th Generation Nano. But do remember that switch is a moving part and as gail from maine already pointed out the longevity of some parts varies according to the user. Apple will bring lots of research about that switch, you will need to bring data proving why you think it should last more than 2 years and 5 months regardless how it is used.


You could have better luck calling AppleCare, asking to be transferred to Customer Service and keep asking to speak to a supervisor if you are not happy with the results.

I think we approached the matter from two angles, Deggie, you from the technical side (I don't have an iPhone so what its limitations are, I don't know) and me from the way in which the the retail trade has to respond to complaints, something I am conversant with.


Meanderful has to take note of both aspects.


You are right about the high cost of electronics here but that may be more to do with a VAT rate of up to 22% plus the fact we have no home industry and have to rely on imports from the far East. You will also know, I'm sure, that UK Apple prices are no reflection of the US prices, largely for these same reasons.
