If somebody has taken my is this app useless if they simply go into settings and slide the button to off next to Find My Iphone?
Can I find my phone if the theif has simply gone into settings and turned the "Find my iPhone" toggle to off?

If you are using iOS 7, then no they cannot easily just turn off Find My iPhone. If they do, then it will ask for the Apple ID password. If it is not showing up, then that means the device is not connected to the internet through cellular or Wi-Fi. Check out the article below on Activation Lock.
