It will not lock in either horizontal or vertical position

Double check
Settings>General>Use side switch for
If it is already on lock change it, exit settings and go change it back,

You can also see which is set by going to control center (swipe up bottom center of home page) if lock icon is there then the switch is set for mute and vice versa.
