I have an iphone 4s i bought and seller does not reply. anyway i can activate it withougvht a sim card its on ios7.1 and i do not know what network it is on. it does not work with my 02 one.

Get your money back if possible
If it turns on, can you go to Settings > General > About and what does it show for the Network?

so what do i do? just try and get a load of sims see what works or what?

You could try calling Applecare in your Country and they may tell you who the carrier is that locked the iPhone
would that actually work so if i gave them the imei number they could tell me?
Serial number and they are under no obligation to tell you and may charge for talking to you
yeah i dont think am willing to pay just to find that out. is there noother free way of finding out already down some money

No, the Activation Lock is an anti-theft protection that cannot be bypassed...if Peter is right and that is also active you have no choice but to get the original owner to release the lock...you will not be able to use it at all otherwise.
but the person i bought it from was off gumtree and i cannot get intouch with them

Either write it off as an iBrick
or make the call to AppleCare ,on balance of probability I would just write it off and next time by from a legitimate source
What Peter brings up is a not an uncommon problem users have with second-hand purchases...
1. A former owner who has not properly prepared the iPhone for resale and is not locatable
2. A stolen item and the seller, for obvious reasons, is not locatable
3. A buyer who is now stuck with an unusable iPhone, and Apple will not get involved since they created the protection system for a very good reason.
Follow Peter's advice and first find out the carrier the iPhone is locked to so you can activate and see if it is not locked to an Apple ID, also.
