Have you tried resetting the phone (nothing will be lost): Hold down the Home and Power buttons at the same time and continue to hold them down until the Apple appears (up to 30 seconds). If the Apple appears, the reset is in progress, and the Home screen will display shortly.

    Cheers,

yes, I've tried doing that multiple times. Unfortunately it has not worked. The phone keeps resetting itself every few minutes. It goes from the passcode screen, shuts off, then the apple screen appears over and over again. The battery goes from fully charged to 0 in about 1-2hours.

    Thanks.

Make sure you have the Current Version of iTunes Installed on your computer

    Then See Here  >  http://support.apple.com/kb/HT1808

You may need to try this More than Once...  Be sure to Follow ALL the Steps...

Take your time... Pay particular attention to Steps 3 and 4.

Some users have reported as many as 8 or 9 attempts were necessary before success.

However... If the Device has been Hacked / Modified... This will not necessarily work.
