I have an old iPhone 3 gs. with ios 3.1.3. how can i update it to at least an ios 5 because it will not let me get games on the app store because the ios is so low.

Update it from iTunes on a computer as described at the bottom of this article; there isn't a Software Update option in General on iOS versions prior to 5.0. It can only be updated directly to the newest iOS release supported by the device’s hardware, which is iOS 6.1.6 for an iPhone 3GS.

Sorry. My previous got posted before I finished it and I then tried to edit it but was unable to do so. (still getting used to the new interface).
As others have said:
You cannot update to iOS 5 but rather 6.x. And you must do it via iTunes on a computer. Sorry for the confusion.
1) My phone is an iPhone 3 gs, and it is in fact an old version. So old that i cannot download things on the app store because they require an i.o.s 6 atleast. 2) I have no clue how to update it.So if you know how can you please tell me. (I have ios 3.1.3 currently!)
Plug your iPhone into iTunes on your computer. Let it sync. Then click "Check for Updates" on the iPhone's summary page in iTunes.
Of course, you must use a current version of iTunes on your computer.

You can't update an iPhone 3GS to iOS 5+? I'm pretty sure a 3GS can run iOS 6.1.6.

That 's my understanding ran out at 3GS iOS6
