Not remembering place in audio books

I have some Audio Books that I downloaded (free ones from the Internet). I am using the latest software on the Mac and the iPod. I have the box 'Remember Position' set to yes.

And yet... It does not remember where I stopped listening.

Any tips as to what it could be?
