You need to get the passcode to the Apple ID to which the phone is locked so that you can turn off the Activation Lock.

Contact the other person and have them remove the iPhone from their iCloud.com FindMyiPhone account.
but i did and he said that he forgot his password and account
Then you'll never be able to use this phone, & Apple won't help you. If you can, return the phone for a refund.

I am quite new here and I didn't know where to post and this topic is very close to the problem I am experiencing.
I bought an iPhone 5S off the internet some time ago with iOS 8.something. I logged into itunes and all was well untill I updated to iOS 9.3.1
Now the phone is asking me for the old users login information and I don't have it.
If somebody at apple could check because I have used this phone for quite some time now. I bought apps on my account, songs and it still asks for the old owners login information.
How can this be? I was logged in the whole time and made all the updates it needed.
Please, I need to use the phone.
If anyone can help me.
