As a preliminary troubleshooting step, I would suggest that you reset your Apple TV using the information in the following article:

I tried to do a software update but it told me that my software was current.
I did a reset and low and behold it said that it was updating my software. After the update
the unit has been working fine. Go figure :-( Anyway, the ATV is now complaint with its operation and I am happy.
Go figure.
