Mac OS X temporarily unavailable?

So, I have Macbook (Laptop) from around 09-10, I decided to wipe the disk so I could give it to my little brother. I contiued to wipe the disk, and it asked if it wanted me to save files, I didn't think my little brother would need all of my assignments on his computer so I declined. After this I went into the re-install OS X Lion, but it contiuously says that the file is temporarily unavailable when I attempt to install after putting in my apple ID. I don't know if I lost the files that should be on the macintosh drive, or the computer finally had its last spinning wheel of doom.

MacBook, It is from 2009-2010
