Migration Problem

Trying to migrate data from an old macbook (10.5.8) to a newly purchased macbook air (10.9.4) but I'm told to update my old computer's software...but when I try to do so, I'm told it is up-to-date--what can I do to transfer my data? What is wrong?

MacBook Air, OS X Mavericks (10.9.4)

Sorry but your response did not help. I followed the updating advice but the old computer says it is updated. I try to use the Migration Assistant but the computer icon that shows up has a yellow exclamation mark BUT when I click on it, it says the computer software is not updated...so I cannot move forward? Does this mean I will have to but a firewire connector and connect the two computers physicallY?

Thanks for all the suggestions (they didn't work). I found out at the Genius Bar that my computer is too old to upgrade (to Snow Leopard) and so I have to (and I have successfully done so) use a firewire to thunderbolt connector. It treated my old macbook like a hard drive (when I booted while holding down the T key). And I was able to migrate everything (it took about 3.5 hours.)
