Go to the apple, left side of the menu bar, About This Mac, More Info, System Report, Hardware, Power and what does it say about the battery Condition, Cycle Count, Capacity?

Depending on the gaming you are doing and how demanding that is on the processor and the graphics module, you may just be seeing a drain from heavy usage.

If you are within the 14-day window after purchase you can take it back for full refund, but you need the original packaging.
