Why have you never backed up the phone? iCloud backups are automatic once turned on and don't require any effort at all on your part.
If you phone is not working, make an appointment at the genius bar and get it replaced. It's under warranty unless you damaged it somehow.
Any data you didn't back up will be lost. There's no way around that.
