Version 4 (newest) requires iOS 8.
Older versions do not.

I'm guessing you don't have children older than about 7, if any. It's not a matter of trust but of concern. And it's not up to Apple to decide what good or bad parenting is. They should make notification an option. I've had to occasionally find my iphone or iPad. I find the email an annoyance. Actually, I have 4 grown children. All of them turned out just fine without wearing a digital leash.
Apple isn't trying to decide what good or bad parenting is. Why you think they should design their products around your shortcomings is your problem. There are options. Explore them and choose one that works for you. We can't alter reality.

In any case, Find My Friends works well in its place.
Assuming that you've gotten the app, you click "add" and type in the email address they use to log in to Apple. An invitation will go out to them. They then go Find My Friends and accept your request. They can then request to follow you and you get an invitation. Then you have to go to the app and accept.

No. Find My iPhone is not, and has never been, intended as a tracking device to spy on family members. The odds of Apple modifying it to accommodate that is pretty much zero.
Frankly, I find the prospect of using for such a little creepy.

This discussion started by asking about the apparently new Find My iPhone email feature. It somehow morphed into a commentary on tracking people. How someone uses a feature such as Find My iPhone is up to them and doesn't need commentary. Apple provides what it provides. But, as in pretty much every case pertaining to technology, when something changes it affects how people use that technology and people want it back the way it was. That was the case here. I don't know what happened, but the email feature has either failed or stopped completely. And then someone asked about Find My Friends, which I find a bit odder than tracking a child via Find My iPhone. I don't really care where my friends are and I don't think they care where I am at any given moment. While you do have to agree to be tracked, there is no notice that someone is tracking you.

True - but Find my Friends does require an opt in on the device.

Just applied the following filter direct on my mail server:
if subject contains "Your Apple ID was used to sign into Find My iPhone" => delete message from server
