Q: Transferring between two phones different iOS

I have two phones both 4S 1 has iOS 6 (not sure version) 1 has iOS7 (Not sure version). I need to back up and transfer the iOS 6 phone to the one with iOS 7. Do I have to upgrade iOS first? or will I be ok as long as the phone I am transferring data too has the newer iOS?

you should be able to use the backup without having to update.

If I'm not late, iPhone to iPhone Transfer can switch data such as contacts, messages, pictures, music between iPhone.
