Given that iPad Air 2 is very new, it's not likely he'll be given a refurb unit. BUT........per the warranty we all are bound to when we purchase an iDevice, replacements can be new or refurbished. But to be honest, refurbished, while not having the greatest connotation, are actually in many ways better than a unit which just rolled off the assembly line. Refurbs undergo screen replacements, internal component replacement and testing to a level far higher than a new unit.

and why are you so sure about that? do you work for Apple?
I'm sure you've asked me this before and the answer hasn't changed. I DON'T WORK FOR APPLE. But when we purchase an iPad or iPhone, replacements per the warranty, can be new or refurbished. The fact that iPad Air 2 is so new, it's just my guess that it wouldn't likely be a refurbished unit at this point. Again, it's my guess.

i know but tha'ts not my problem Apple has a presence worldwide and should treat his customers equal worldwide. Im going to start to dealing with this issue more formally next Monday.

The laws in Mexico protecting consumers are weaker than those in the U.S. and Apple isn't going to go out of their way to lose money. The same thing applies to the Tax Code here in the U.S.. They aren't going to part with one dime more in Corporate Taxes if they can use a loophole and incorporate in Ireland and pay millions less. They play the laws in every country, some of which they probably helped write, like a seasoned concert violinist. Sorry they aren't making things right for you as they should, but Apple is just doing what they do.

then i'm gonna do what i should do which is not buying anymore Apple products. End of the problem.

Sometimes the seller does better, like Costco, but don't know what their policies are in Mexico. Here, iPads bought at Costco have a 90 Day no hassle return policy, whereas Apple has 15 day.
