i bought an iphone 5s from a guy online its saying the phone is stolen and i cant get passed the apple id screen he gave me both the email and password but nothing has changed

If you have a device that has a message that is stating it is stolen and you retain this device, then you have, in most jurisdictions, committed a crime. Knowingly possessing stolen property is against the law. Turn the device in to law enforcement. You have been swindled.

I would suspect you have a stolen phone. There isn't anything more than the link I gave you above I can do. He has sold you a phone that doesn't work -- press for a return.

That is the craziest thing I ever heard!! Why would you believe Apple would do that? Your beef is with the idiot you bought it from. Get him to refund the money!
That's between you and the seller -- or maybe a site like eBay if you used something like that.
You are in knowingly possession of stolen property, which is a crime in most jurisdictions.
You should report the seller to the police.
