i was given my sisters phone. She passed away and I need to remove her apple ID link and do not have any passwords etc.

You will need to contact Apple directly. Use the Contact Us link in the bottom right of the pages here. You will proably need to provide them information about her death before they will consider removing the Activation Lock.
