Do Apple EarPods come with a warranty

So I got them with my iPhone 5s in July 2014. I need a apple worker to help me. That picture shows the only damage when my baby bro bit them in like October it didn't have any effects on the sound or the EarPods . The right ear phone stoped working yesterday and the remote started glitching pauseing and playing my music at random times this probably happened because I run a lot and the sweat messed it up. Can Apple replace or repair the EarPods I still have the one year warranty. And there is another damage on the bottom where the little rubber came off from too much bending in my pocket

The warranty on the pods would have the same manufacturers defect warranty as the phone but in this case because someone bit them it is not a manufacturing defect. The bitting may not have had an immediate effect but you'd have a hard time convincing Apple it had no effect. User damage no matter how it's caused is not covered by the standard warranty.
