My iPod touch won't update to ios 5 it's says THE IPOD SOFTWARE UPDATE SERVER COULD NOT BE CONTACTED does anyone know how to fix it

Try updating the iPod by hooking it up to the computer and updating it through iTunes.
You need iOS 5 in order to upgrade wirelessly. You cannot do that yet. See:

If an update is available there will be an active Update button. If you are current,
then you will see a gray screen with a message saying your are up to date.

Try:
- Powering off and then back on your router.
- iTunes for Windows: iTunes cannot contact the iPhone, iPad, or iPod software update server
- Change the DNS to either Google's or Open DNS servers

- For one user uninstalling/reinstalling iTunes resolved the problem
- Try on another computer/network
- Wait if it is an Apple problem
