I set up guided access, now the home button does not respond when I triple click. I can't seem to power down either. Is this a known issue? It's a new ipad with new os update.

You say "It's a new iPad ..." but your profile says you have an original iPad running iOS 5.1 (at the bottom of your post above).
Anyway, this explains how Guided Access should work:

If triple clicking fails, try resetting the iPad. Hold the on/off and power buttons together for about 10 seconds until the Apple logo appears.

I have an original ipad along with an ipad 4, that title on the bottom of my post must be from my first registration with Apple. My issue is with a brand new 2015 updated ipad mini. I had to shut down to get out, I know how to use guided access,thanks for the link. Anyway, just wondered if there are known issues with this.

Apple has not introduced an iPad in 2015. The iPad Mini was introduced in late 2012. The iPad Mini with Retina Display was introduced in late 2013. The current iPad Mini, known as iPad Mini 3, was introduced in late 2014. If the iPad Mini 3 is the model you're talking about, it is under warranty and you should take it to an Apple Store or Authorized Apple Service Center for evaluation.
I haven't seen any post where a person could triple click to turn on guided access but then couldn't turn it off by triple clicking. It doesn't mean somebody may have had problems, just I haven't seen them.
One thing you might try is to go to settings> general> accessibility> home-click speed> set to Slow or Slowest.
