yes and the power botton on the top is stuck like someone called my phone then when i was about to answer it went black my phone was at 79 percent

If the power button is indeed stuck, it will need to be repaired. This happened to one iPhone 4 that I owned. I woke up one morning after the phone was previously just fine the night before and the button was no longer clicking or doing anything. Since it was no longer under warranty, I had to pay the flat $150 (I believe it was) repair fee and my device was replaced in the Apple Store. I would assume they will do the same in your case.

Before your reservation, make a backup of the device using iTunes. Restoring this backup to the new device (if you choose to go that route) should make the transition to the new device nearly seamless.
