my iPod touch is factory reset but having an error with creating Apple ID

hi, we bought my son a used iPod we got it home to try and set it up and it's saying it cannot create an Apple ID because it cannot create Apple iCloud account the device is not eligible? I've never seen tgis before can I fix it or did I buy junk?
