My sons' itouch got lost, can it be opened or reformatted via jailbreak?

If it is a 5g iPod with iOS 7 or 8 and Find My iPod has been turned on (it is ON by default), it cannot be opened or reformatted by anyone else without you removing it from iCloud using your Apple ID and password. If it is an earlier iPod, it cannot be opened without the password, but it can be reformatted by anyone.
