When I toggle silent mode on or off nothing happens. Also the phone always ring and it is pretty annoying when I am in class for example. So I would like to know if there is a way to fix it or if it is a hardware issue.

Try to reset the phone by holding the sleep and home button for about 10sec, until the Apple logo comes back again. You will not lose any data by resetting, but it can cure some glitches.
To keep the phone from ringing you can also try: Settings/Do Not Disturb -> on
