im trying to backup my phone 5 with smashed screen but wont let me as iv got a screen lock on does any one know of a away of getting round this? needing too it as now got new phone and need all contacts ect kind regards ross

Unfortunately you cannot. If you do not have another backup of the device, you will not be able to restore to a backup. If you cannot enter the passcode, there is no way around it. It is kind of a security feature, otherwise people would be able to smash a screen and enter your phone. Hopefully you have earlier backups.
It's too late now, without the passcode you will not be able to backup/restore.
If your smashed iPhone has in Settings > iCloud turned on for Contacts, it will automatically sync to the new iPhone when you set it up using the same Apple ID & password.
