error code -39 when trying to update and or restore ipod touch due to password problem. Wont allow what do I do?

I have been locked out of my ipod touch version ios8...not sure of its exact operating system. Someone tried to get into

my ipod not knowing the password and it has now locked me out. I tried to update and it did not let it so I went to restore. I received the

error code (-.39) not sure what this code is and how I go about proceeding with restore. Can anyone help me on this, please?
