UK Consumer Law

Since this is of course an issue with the MacBook Pro on sales of the item, how can someone prove that it existed at the begin of the sale and wasn't due to wear and tear/usage?

I ask this since UK Consumer Law states the retailer is the one liable for refund/repairs and they want confirm it was defective on the point of sale.
