How do I unlock an icloud account? Can get hold of the person using the iphone before

You can't. If you can't find the prior owner then you have a pretty paper weight.

You can't, and Apple won't do it for you(unless you're the original owner); the activation lock is an anti-theft measure. You may be able to get a refund for it.
