iPhoto missing, app store seems to think I already have it.

I just bought a refurbished Macbook Pro from Apple. I got it home and started it up and it downloaded the latest version of Yosemite (10.10.2). I just went to put all my photos on the new Macbook but iPhoto is not installed on my laptop. I went to the app store and all it did was ask me to accept. It doesn't allow me to download it. I'm baffled as to what is going on or what to do next.

MacBook Pro (13-inch Mid 2012), OS X Yosemite (10.10.2)

Yes, but nothing happened. I tried it again and it said I already accepted it.

Could it e, that iPhoto is installed on a connected backup drive? Eject all connected disks and then launch the App Store again and try the download again.

If that fails, search your Mac with FindAnyFile (http://apps.tempel.org/FindAnyFile/index.php) for any occurrence of iPhoto.
