iphone wont activate just says searching at top with wifi signal

i brought a second hand iphone4s the man showed it me working with all apps, i erased all content to setup as new phone it just says searching where the signal is with a wifi signal next to it, when i try to activate the phone it says could not activate iphone as server is down. anyone any ideas how to fix please? thanks nick
