A second generation iPod touch can't be updated past 4.2.1.
If you don't know what device you have, append the last three characters of its serial number to http://www.everymac.com/ultimate-mac-lookup/?search_keywords= and load the page.

More than likely, the device is at the end of its life and that is the last iOS it will support. See this link to an article in Wikipedia that explains the version history and what each device will stop at. http://en.wikipedia.org/wiki/History_of_iOS

Is there anyway to get the photos off this device on to my computer or a flash drive? It has IOS 5.1 and can't be updated further. I found a I-flashdrive that need ISO 7 or higher. Need to save these photos!
APPLE PLEASE UPDATE ICLOUD TO SUPPORT PHOTO STREAM VIA ICLOUD SO PEPOLE HAVE A WAY TO GET THEIR PHOTOS AND VIDEOS!!!!!!

Off what device? You provide no information here. You can connect an older iPod Touch to the computer and import your photos to the computer. iCloud is not necessary. The earliest iOS that iCloud can support is iOS 5. Earlier iOS cannot be changed to support it.
Its the original IPAD with IOS 5. I didn't think the device was as important maybe I'm wrong.
Please share any ideas how to get the photos off.
FTR: I went through level 1 &2 apple tech support and they couldn't come up with a solution - so you know I tried all the obvious methods.
Okay, you have an iPad with iOS 5.1.1. Your first post was about getting photos off an unknown device, and the original thread was about a device that would only run up to iOS 4.2.1. Your iPad with iOS 5.1.1 should have iCloud support, however that is not the only method to import photos. Are you trying to import photos to save, or are you trying to delete some photos from your device that you no longer want?
Are these photos that you took with the iPad? Are these photos in the Camera Roll, or are they located somewhere else? If somewhere else, where are they located. Since I would have no idea what the problem was when you worked with Level 1 & 2 of tech support, it is hard to provide an idea of how to get the photos off. Why don't the obvious methods work? What happens when you try to import the photos? Please explain more of what you are trying to do and what has happened when you have tried other methods.
