volume of ipod touch keeps fluctuating on its own

ive had an ipod touch 32gb 5th gen since christmas. all good except whenever i have headphones in (either the Apple ones or any others) sometimes the volume will go all the way to the max, and if I try to decrease it it just stays stuck on the maximum settings, and the same goes for when it goes down just vice versa.

It happened a few times. now its happening every couple of days and becoming a real hassle. Ive restarted, updated my touch and everything. It isnt anything to do with a case because with or without a case it still happens, in or out of my pockets

what should I do? should I take it to an apple store or what? is apple working on a fix for this

iPod touch, iOS 8.1.2

Try:

- Reset the iOS device. Nothing will be lost

Reset iOS device: Hold down the On/Off button and the Home button at the same time for at

least ten seconds, until the Apple logo appears.

- Try another set of headphones

- Reset all settings

Go to Settings > General > Reset and tap Reset All Settings.

All your preferences and settings are reset. Information (such as contacts and calendars) and media (such as songs and videos) aren’t affected.

- Restore from backup. See:

iOS: Back up and restore your iOS device with iCloud or iTunes

- Restore to factory settings/new iOS device.

If still problem, make an appointment at the Genius Bar of an Apple store since it appears you have a hardware problem.
