Apple TV won't update 2015

ive powered off, re-booted, hard booted, reset, and restarted. There is no USB port so iTunes update is out. Update gets to step 1 of 2 "the update was not successful". 5.1 update currently. Also unit has always had "activation failed" status, if that matters. Unit works otherwise. Is update even necessary?
