my child put a passcode on an old iphone4 that I was keeping because I needed text and information from it in litigation I have ongoing. Therefore, I can't re-set the phone because I will lose all the text messages and data. I need some help please! Anyone have any suggestions?

Sorry to hear that. Unfortunately, the only way to remove it is to erase it.

The only thing I could add is to suggest your child use the passcode to unlock the iPhone, or share the passcode with you. (You have not told us the age of your child.)
He is a toddler. I guess the bright side is he has a definite future in technology. He also changed the wallpaper.

I hope you backed it up to either iCloud or iTunes on your computer, as you would back up any important data.
