I have a new Iphone 5s but can't download my latest Icloud backup as it was made on IOS83 and the Iphone only has IOS8. I tried to download IOS83 on it but it won't do it as the phone isn't set up yet. What do I do?

Set up the new phone as a new device, then you will be able to update it to iOS 8.3. After that, go into the Settings App > General > Reset > Erase All Content and Settings. Then you can set it up again, and choose to restore it from your backup at that time.
