Vmware ESXI

Hi! Have an question regarding running Mac OS X Yosemite "Virtual"!

1. Using VMware ESXI for test and have read blogs that it should be legal in EU to run Mac OS X as "Virtual" instance on non Apple branded hardware!


Anyone know if this is legal with ex. Yosemite?

Due to Apple licensing restrictions, you may only create and run this virtual machine on Apple-labeled hardware. For more information, see Apple's Hardware & Software Product Agreements.

Hi etresoft!


Read on a blog from a user in EU (France), that it was legal in his country, assume it isn't legal, but tried to find info from Apple, but didn't succeed yet :-)

In USA : Yes, in Europe : it's prohibited.


It's perfectly legal in Europe to use HP Hardware for use OS X with ESXI, if OS X is legally obtained.


Apple can't requires that OS X be only run on Apple-branded hardware in Software License Agreement for Europe.


European's laws are traducted in country laws, for exemple in France it's about L. 518-1 of Consumer Code

Blogs are not legally binding international regulations. People sometimes try to make a claim that some EU law prohibits one of Apple's business practices. But until said claim is proven in a court of law, it is invalid. A recent successful example was the 2-year warranty claim. By Apple's interpretation of the law, Apple was acting legally. The EU had to issue a ruling that specifically said Apple's interpretation was wrong. If you think Apple is also wrong about its interpretation of this particular law, you are free to contact your EU representatives and have them address the issue. You may be required to demonstrate some harm first.
