Q: "Number of items" search attribute in Smart Folder

I'm trying to create a smart folder using search attribute of "Number of items" but it is not behaving the way I expected.  The smart folder says:

 

     Number of items: Number of files and folders in the folder

 

So, I assumed that I can use this to distinguish empty folder from non empty folder.   So for testing, I created 3 folders which contains 0, 1 and 2 files.

Looking at the Info, empty folder seems to contain 1 item (itself?), so Folder 2 and 3 reports 2 and 3 items respectively:

But, when I create a smart folder with "Number of Items" criteria, it does not behave the way I expected.   Here is the output with criteria of "Number of items" to be equal to 1.   With this, I expect only "Folder 1" to be visible, but all of them are visible:

and if I set the number to 2, all the folders disappear, while I expected only "Folder 2" to be visible.

So the behavior is that from Smart Folder's point of view, all the folders are considered to contain 1 items regardless of how many they actually contain.   Is this they way it behaves for other people?    I would appreciate your feedback.
