in iTunes if I go to File> home sharing > choose which photos to share with Apple TV , I don't get the option to select photos , and if you go to select folder I can't select the photos library either as its greyed out, I've seen a few posts like this but none with any answers, so I'm guessing it's a bug soon to be repaired.

Make sure iTunes is up to date. Toggle off/on home sharing. Reboot.

i toggled home sharing on and off a number of times before you posted and it didn't work, but strangely after your post it did, you must have magical powers!
