why can't I update my 4s to iOS 8 or later?
iPhone 4S, iOS 7.1.2
We don't know. Could you describe how you try to update (OTA, via iTunes), do you see any error messages?

If you are being told that it is already up to date, this would indicate that you have an iPhone 4, not a 4S.
Please check the model number at: Settings - General - About - Model = ???

That is indeed an iPhone 4. It can not be upgraded beyond 7.1.2.
I have tried updating via the phone and via iTunes, both state latest version?
If you have 7.1.2 that is the latest version.
