Iphone 4 received as gift, set up attached to son's itunes account. Cannot update/purchase from itunes as don't know password and he doesn't use the account anymore and the email account it is attached to is obsolete.

You can logout of an account by tapping on the id in Settings > iTunes & App Store, and you can then log in with a different account.
Any item that was downloaded by your son's account will remain tied to his account, so only his account will be able to download updates to those apps. You would need to delete and buy/download those apps with your account to be able to download future updates to them, or you could get the password to his account reset e.g. by answering the account's security questions on http://iforgot.apple.com, or by your son contacting Support : Contact Apple for help with Apple ID account security - Apple Support
