My iPod is locked, what to do?

Here's the problem:

Five years ago I bought an Ipod. After three years, I bought an iPhone. So I reset the iPod. And I put him away. One year ago, my brother asked if he could use the iPod, so I gave him the Ipod. But he used it only a week. He put him away. Now, two weeks ago I wanted to use it again, but my brother had forgotten the code. He had set by himself. Then he tried it so often that the iPod is completely blocked. Now it says "iPod is locked. Connect with iTunes.". I connect the iPod with iTunes on the computer but than, the computer says: "Itunes could not connect to the iPod touch iPod touch because it is protected with an access code you must enter your passcode on the iPod before it can touch with iTunes, may be used.

As you read, I can not unlock my ipod how do I solve this.

PS: I am using the latest version of Itunes

PSS: It's not stolen, I can prove that with the coupon.

thanks in advance
