If the owner of he iPod has totally forgotten the apple ID and the password when activating what should the person do

I have problem , i had to buy out a phone that was on my account but the relative wasn't paying on it. so she gave me back the phone and i have it but she won't unlock of give us the id and password. so I want to use theis phone for myself. Use Apple's iForgot service, or contact their Account Security team, or if they're the device's original owner, take it and its purchase receipt to a physical Apple Store.
