Servers EnterpriseAs long as your original purchase was 3.X you are eligible for a free update to 3.8.
Make sure your original ARD is installed on your computer. App Store should see it and serve you with the update.

Servers EnterpriseIf the install disk is lost, you're probably out of luck. You need a currently installed version. Also, it must be updated to 3.7.2.
My opinion about 3.8 is however negative. For me it is not an improvement at all. So I went back to 3.7.2

Apple Remote Desktop 3.7.2 Admin
Once the retail DVD version is installed, you can go to the App Store and have your copy converted to 3.8.
You must be running OS X, v10.10.2 or later.
