SImple, Lucky Gallery, Muzaffarnagar is not an Apple Authorized reseller (according to https://locate.apple.com/in/en/). By definition, a non-Authorized seller is selling items that they did not obtain through Apple's official distribution channels. They are selling used, stolen or counterfeit products. Apple has no control over non-Authorized resellers, and will have no way of knowing what they sell or how they came to have the products they sell.

An Authorized reseller would never sell a demo unit except by accident, and would acknowledge that accidental sale if challenged about it. A non-Authorized seller will sell anything they can get into their inventory, from whatever source they wish to accept items from.

Hi Apple,

I purchased iPhone 6 in October month from Lucky Gallery, Muzaffarnagar (Pin-251001). In starting of this month my earphones got some issue and I went to iPhone Service Center (Pacific Mall, Anand Vihar, New Delhi ) to get them replaced.

They told me your earphones are duplicate and cannot be replaced. I checked the same with iPhone customer care, they also confirmed the same.

One more bad thing I got to know from them was, iPhone sold to me is a Demo Phone.

Now points I want to raise here are..

  1. If Apple is has policy to not sell Demo phones to end customers and they provide Demo phones to only authorized entities, how this phone came into market. Isn’t it due to fault in your process ?
  2. What Apple did for end customer awareness in India so that they can easily recognize Demo phones and get rid of such frauds ?
  3. Why can’t you trace that Apple authorized firm/entity to whom you provided this Demo phone they leak it to market ?
  4. Why can’t you take action against those sellers who are damaging your (Apple) image in front of End customers ?

I hope you will understand pain of a customer who spent thousands of Rupees on your product with some faith.

You can find all detail in Apple case: 100144466791

How do you suggest Apple prevent theft and resale of demo phones? Or simple human errors?

The only way to determine if it's a demo phone is to turn it on and examine the software.

How do you know they're not? They may well take action against resellers who sell demo phones. I'm not sure how that's going to help with stolen phones.

Hi Apple,

You can find all detail in Apple case: 1XXXXXXXXXXXXXXXX

No, we can't. We are your fellow users. We have no access to any case information.

Just one concern here.. If customer is reporting issue that Demo phone was sold to him from particulate shop with proper bill information. Why cant they trace take action against that seller that how did he sold Demo phone and trace from where i got it.

Apple Customer care is denying to help. They are saying we do not help in such cases.

Moreover there is no particulate Apple email ID where i can escalate this case.

Any Suggestion ?

Agree with you.. But I am sure if my product is getting sell in illegal way, i can take action against him.

Also from IMEI number i can trace that authorized entity to whom i provided this Demo phone. If this phone was theft from them they should have FIR copy. Else they are selling these Demo phones.

If a company is manufacturing Demo phones and creating rules that they can not be sold. They should have some rules for people they are providing those Demo phones. Also they should spread awareness to end customers about Demo phones and how they can recognize while buying. Its their responsibility.

No, it is not. Apple, nor any company, is responsible for where you chose to shop or what you chose to buy. Nor are they in the business of enforcing consumer or retail sales laws or tracking down theft or stolen items. Nor are the required to do your own consumer research for you. If you purchased a stolen watch from some shady shop somewhere, is the Watch manufacturer responsible for that? No, of course not.

Apple provides a system of Authorized Resellers, and a web site to find them, just so consumers can avoid such situations. You are free to shop outside of that network of sellers, but any consequences of doing so are entirely yours to deal with. Nothing about your situation is Apple's responsibility.

Hi Michael,

Got you mate.. But don't you think Apple should stop creating Demo Phones or at-least print some symbol on back of Apple so that customer will not go in such situation. Ultimately a big name/company has some responsibility towards their customers.

Ultimately the Demo phone i have was given to some authorized person. The only way this phone came in unauthorized hands was theft. And if it was theft, that authorized person should have FIR filed for it. If Apple found no FIR for it from that person, that means he himself sold the phone in unauthorized circle and action should be taken against him by Apple.

Isn't it ?

You don't know who originally had that demo unit. It may have been an Apple employee, or it may have been an employee of an authorized reseller, who is an independent business and whose employees do not work for Apple. And you have no idea what action may have been taken against them, in whatever country they worked, as it also could have originated anywhere in the world Apple or its Authorized resellers do business.

Bottom line is, if you buy from a non-Authorized seller, or a private party, you pay your money and you take your chances. You, as the consumer, are ultimately responsible for what you buy and from whom. Any complaint you have would be with the seller you used, for selling something they never could have legitimately added to their inventory in the first place. Apple nor any company is responsible for their products that are sold illegally by someone else.

The only difference between a demo phone and the consumer version is the model number and the software loaded on it. It's been a while but I was able to successfully remove the demo software by putting the phone in DFU and restoring it. I have no reason to believe that's changed, though I could be wrong. If it's still the case, the worst problem you have is that someone may have sold you a used phone as new. Or, they sold you a demo phone that was never used for display purposes. If they sold you the phone in the original box, it would have said that it was a demo on the box.

I bought it from phonehouse, an authorized reseller that went bankrupt and sold their inventory online. They wont take it back since they are out of business. It seems that I'm stuck with a demo model that does not work, and yes, of course, I should have paid more attention and I feel terrible about it. Now I just hope that there is someway to make this phone work, since im just a student and I paid a full price.

Do you mean those available in stores to try out?

If so, those should not be sold to customers, while hardware is the same as a regular Phone, the iOs installed on those is for demonstration purposes, and lacks many of the features of the full iOS operating system.

However, if you restore the phone, it wipes the demo software and the phone reverts to a regular phone. I believe I had to put the phone in DFU to do it, though.
