So they replaced it and it worked for a time, or they tried replacing it and since a replacement did not work, they declared it dead?

Other than battery and screen replacements, Apple does not repair iPhones, they replace them. They are not really "repairable", especially if you're talking about a logic board failure. The logic board would have to be replaced (which they won't do) and if it were replace, the storage that your data would have been in is soldered to the logic board.

Your photos are gone, I'm afraid. Next time, turn on iCloud backups or make sure you back up to your computer on a regular basis.

Do you have the phone in your possession? Not sure what you mean when you state that you have "been told the phone will not fire up". If you sent it into Apple for repair and they are telling you this, then you won't be getting that device back, so you won't be able to retrieve the photos.

If you do get the phone replaced, please set up automatic iCloud backups. You do not have to do anything except plug your phone in. When it automatically goes to the Lock screen, and you are in Wifi range, the backup takes place without any intervention or effort from you. Your photos are valuable, and keeping them on the device and the device only will ultimately lead to them being lost one way or the other. What if your phone was lost or stolen? What it if fell in a lake? What it if had to be put into Recovery Mode in order to get it up and running again. Bottom line, an iPhone is not a safe place to archive precious data of any sort.

Sorry about the bad news,

when they tried replacing the battery, the phone still didnt come on, therefore as you said declared it dead

by baby spent 2 months in intensive care, and the last couple of months at home have been ever so busy and tiring, that's why i didnt get a chance to backup. i thought i had icoud on, but was told by apple that i was on the version that saves pics for only the last 30 days.

i so desperately want to get these back

shpuld i turn to data retrieving companies? or i have read about sofware that can retrieve data

The problem with a data recovery place is that they are going to have to open the iPhone to do it and at that point your warranty is no longer valid from Apple and you will still have a non-functioning phone. Also, they will usually charge you just to look at it whether or not they can actually recover the data. So you have to ask yourself what those photos are worth. If you say they are priceless and you can afford it, then sure, send it to a data recovery place and buy yourself a new iPhone. If it is "dead" then there isn't any software that you could buy to recover photos. The device needs to be able to power up in at least some way for the computer to read it. A data recovery place will have to physically remove the data from the device.

Like others have stated, once you get a new iPhone, turn on iCloud backups. It only takes a couple of seconds.

I'm sorry that you're going to lose your photos. I understand that it must have been a very trying time for you. However, if you had simply plugged it into your computer, iTunes would have backed it up for you. It would have taken a matter of minutes. Turning on iCloud backups, which you're prompted to do when you set up the phone, would have taken seconds and then would have been automatic. The likelihood of a data recovery service being able to get your photos back is extremely small.
