You've received a couple of suggestions, but not the best solution: buy a new iPod Touch.
Well that does not seem like the best solution to me, just because they updated software doesn't mean you shouldn't be able to download old versions of apps on a older device...
The newest version of iOS is not able to run on the older hardware in your iPod which is why you can't upgrade it. So, to prevent users from being puzzled over why software they have downloaded doesn't work unless they upgrade iOS, this will let them know they cannot upgrade further.
