Take it and the proof that you own it to an Apple Store.
This is user to user forum. You are not addressing to Apple here.
You shold contact the owner and ask him to remove this iPhone from his list of devices. Otherwise, your iPhone will be a useless brick. If you cannot contact the owner ask for refund.
