Unfortunately, you cannot do very much with your phone unless you get assistance from the previous owner, they should either provide you with the password to unlock it or remove their account from the phone entirely remotely through iCloud.com > Find My Phone.
now i want to make it clear that i haven't seen him since a year and i want to make it clear that i didn't steel it from somebody and i never will. So i need only one chance to use this iphone again.
Sorry, you had that one chance when you accepted the phone from them, if you can't contact them, buy another phone and this time make sure it doesn't have an iCloud account registered to it.
