an upgade to ios4 locked my partners phone ..How do I open it? we have neve protected that phone with a password!!

Whether you put the passcode on the phone or not, If the phone is giving you a message indicating that you need to enter a passcode to unlock the device, you will have to restore the iPhone in order to unlock it.
